Why UCITS?
With the global investment landscape changing dramatically, particularly in the area of regulation, a number of alternative investment managers are launching a new breed of structures domiciled in either Dublin or Luxembourg – UCITS III funds (Undertakings for Collective Investments in Transferable Securities). UCITS III structures are specifically designed for hedge funds which, under the European UCITS Directive, can then be passported across its member states. Now, however, UCITS III is fast becoming a preferred structure for hedge fund investors all over the world. With the increasing threat of stringent regulation emerging from European law-makers, it may soon prove impossible to sell offshore hedge funds to many institutional or retail investors. UCITS is exempt from the scope of the European Commission’s draft Alternative Investment Fund Manager Directive. UCITS managers have a greater ability to control risk and have more scope for positive returns compared to traditional long-only products whilst investors are offered the same high levels of protection.
